The online portal available at www.medeverest.com is provided by the Service Provider under the terms specified in this document, which constitutes the regulations in accordance with the Act of July 18, 2002, on the provision of services by electronic means (hereinafter referred to as the "Regulations").

These Regulations define the rules for using the Portal, the types of services provided through the Portal, and the rights and obligations of the users and the Service Provider. Familiarizing oneself with these Regulations is the obligation of every Portal user.

 

 

I. DEFINITIONS

 

1. Portal - an online portal operating at https://medeverest.com/.

2. Service Provider – Medical Practice Medeverest Robert Szymczak based in Gdańsk (80-360), at ul. Bolesława Krzywoustego 19F, NIP: 5841943576, REGON: 220148318.

3. User - a natural person who uses the Services provided by the Service Provider.

4. Service – services provided electronically through the Portal.

5. Paid Service – products prepared by the Service Provider.

6. Order Form – a form available on the Portal enabling the placement of an order for a Paid Service.

7. Newsletter – a service allowing subscription and receiving free information about Goods and promotions from the Seller via electronic means.

8. Working Day – one day from Monday to Friday, excluding public holidays.

 

 

II. GENERAL PROVISIONS

 

1. The Service Provider undertakes to provide services to the User in the scope and under the conditions specified in the Regulations.

 

2. The User undertakes to use the Portal in accordance with the rules set forth in the Regulations, applicable laws, and principles of social coexistence.

 

3. Using the Portal and the Services, including Paid Services, means the User's acceptance of the conditions specified in the Regulations and the Privacy Policy.

 

4. The Service Provider complies with the principles of personal data protection of Users provided for in the regulation of the European Parliament and Council (EU) 2016/679 of April 27, 2016, on the protection of natural persons in relation to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC. The User consents to the collection, storage, and processing of personal data by the Service Provider for the purpose of service delivery. The detailed principles for processing Users' personal data are specified in the Portal's Privacy Policy. The Service Provider may use the User's data for marketing services only with the User's explicit consent or based on applicable legal provisions.

 

5. The User is obliged to use the Portal in a manner that does not disrupt its functioning, particularly by not using specific software (including malicious software) or devices.

 

 

III. GENERAL TERMS OF SERVICE PROVISION

 

1. The Service Provider offers publicly available and free services through the Portal, consisting in particular of:

a. enabling the User to access the Portal, including content, articles, news, and other information

b. posted on the Portal and displaying them on the User's end device,

c. sending to the User's email address periodic information about promotions, services, or other informational materials in the form of a "Newsletter."

 

2. The agreement for the electronic provision of the "Newsletter" service is concluded for an indefinite period upon the User's registration for the "Newsletter" service using the functionality available in

the Portal.

 

3. The Service Provider allows the placement of orders for Paid Services through the Portal.

 

4. Information about the Paid Service available on the Portal constitutes an invitation to conclude a contract within the meaning of Article 71 of the Act of April 23, 1964, the Civil Code.

 

5. All prices listed on the Portal are given in Polish zlotys (PLN) and are gross prices.

 

6. The Service Provider reserves the right to make changes to the prices of Paid Services available on the Portal, to introduce new Paid Services, as well as to conduct and cancel promotional actions or make changes to ongoing promotions. The changes mentioned in the previous sentence do not apply to contracts concluded before the Service Provider introduces changes.

 

7. Technical requirements necessary to use the services provided by the Service Provider:

a. a device with internet access,

b. a web browser that supports Cookies,

c. access to email.

 

8. The User is responsible for charges related to access to the Internet and data transmission according to the tariff of their Internet service provider.

 

 

IV. PAID SERVICES

 

1. The Service Provider offers Users the option to order Paid Services through the Portal according to their description and available variants on the Portal.

 

2. In order to order a Paid Service, the User:

a. selects the Paid Service,

b. fills out the Order Form providing the required data,

c. makes payment for the order according to the selected payment method.

 

3. The Service Provider, upon receiving the order, promptly sends to the email address provided by the User a message containing the order confirmation and specifying the essential terms of the agreement, which is concluded in connection with the submission and confirmation of the order.

 

4. Upon receiving the message referred to in paragraph 3, an agreement for the provision of the Paid Service subject to the order is concluded between the Service Provider and the User.

 

5. The Service Provider executes the Paid Service within 5 business days from the moment of determining with the User the necessary information for the proper preparation of the purchased product by the User.

 

6. The Service Provider allows the User to place an order for other services, including the purchase of products with different parameters not included in the standard offer. Ordering services mentioned in the previous sentence is based on individual arrangements between the Service Provider and the User. To order services, the User is obliged to contact the Service Provider using the contact form or by phone or electronically using the Service Provider's contact details.

 

 

V. PAYMENT METHODS

 

1. The Service Provider allows payment for Paid Services in the form of prepayment:

 

a. via the electronic payment system Autopay S.A. based in Sopot at ul. Powstańców Warszawy 6, registered in the District Court Gdańsk - Północ in Gdańsk, VIII Economic Department KRS under number 0000320590, with a share capital of 2,205,500 PLN (fully paid), NIP: 585-13-51-185; entered in the register of payment service providers under number IP17/2013, in the register of loan institutions under number RIP000109, in the register of credit intermediaries under number RPK002057, in the register of telecommunications entrepreneurs under number 11050.

 

b. via PayPal (service PayPal (Europe) S.à r.l. et Cie, S.C.A.), located at 22-24 Boulevard Royal, L-2449 Luxembourg, registered as a payment service provider in Luxembourg (no. B118349); a global electronic payment system established in 1998, offering email payments, international transfers, and transaction security, handling billions of transactions annually.

 

2. The Service Provider, at the User's explicit request, documents the sale of the Paid Service with proof of purchase.

 

 

VI. DELIVERY METHODS

 

1. The Service Provider delivers its products and services:

 

a. by telephone and electronically - via email, audio/video communicators (Skype, Zoom, Teams)

 

b. in person, at a training/consultation location agreed upon by both parties

 

c. by mail, using the services of Poczta Polska S.A. based in Warsaw, at ul. Rodziny Hiszpańskich 8 (00-940 Warsaw)

 

 

VII. LIABILITY

 

1. The Service Provider is not liable for the User entering incorrect data (especially by providing incorrect data in forms available on the site), transmitting incomplete or incorrect information on which Paid Services are executed, as well as the User's actions that hinder or prevent the provision and execution of services by the Service Provider.

 

2. The Service Provider is not liable for the consequences of the User using the Portal in a manner inconsistent with the provisions of the Regulations, applicable laws, and the principles of social coexistence or customs.

 

3. The Service Provider reserves the right to suspend or terminate the provision of certain functionalities of the Internet Portal due to the need for maintenance, inspection, or expansion of the technical base or software. The suspension or termination of the provision of certain functionalities of the Portal may not violate the rights of the User.

 

 

VIII. WITHDRAWAL FROM THE AGREEMENT

 

1. A User who is a consumer has the right to withdraw from a distance contract or a contract concluded outside the premises of the Service Provider within 14 days from the day the contract was concluded. To meet the deadline, it is sufficient to send a statement to the address of the registered office or email address of the Service Provider.

 

2. In the event of withdrawal from the contract, it is considered as not concluded and the consumer is released from any obligations. Payments made by the consumer will be refunded by the Service Provider in the same form in which the consumer made the payment, unless the consumer agrees to a refund in another way that does not impose additional burdens on them. The refund occurs within 14 days from the date of withdrawal from the contract.

 

3. In the case of a contract for the provision of services, if the service has begun with the explicit consent of the consumer before the statutory withdrawal period has expired, the consumer, in the case of withdrawal from the contract, is obliged to pay the Service Provider for the services performed up to the moment of withdrawal from the contract.

 

4. In accordance with Article 38 of the Act of May 30, 2014 on consumer rights, the right to withdraw does not apply, among others, if the Service Provider has fully performed the service with the explicit consent of the consumer, who was informed before the service began that after the service is performed by the Service Provider, they will lose the right to withdraw from the contract.

 

 

IX. COMPLAINT PROCEDURE

 

1. In the event of non-performance or improper performance of services by the Service Provider, the User is entitled to submit a complaint electronically to the Service Provider's email address.

 

2. A properly submitted complaint should include the User's identification (name and surname and email address), the subject of the complaint along with the indication of the period of time to which the complaint pertains, and the circumstances justifying the submission of the complaint. In case of providing incomplete data, the Service Provider will request the User to complete the data.

 

3. The Service Provider will consider the complaint within 14 days from the date of receiving the complaint. Failure to consider the complaint within 14 days means its acceptance by the Service Provider.

 

 

X. INTELLECTUAL PROPERTY

 

1. All content posted on the Portal (including graphics, texts, page layouts, and logos), not originating from Users or other providers, is protected by copyright law and is the exclusive property of the Service Provider. Using this content without written consent from the Service Provider results in civil and criminal liability.

 

2. The User is obliged to use all content posted within the Portal only for their own personal use. Use of the content in any other scope is permitted only if explicitly indicated by the Service Provider on the Portal.

 

3. Use of the Portal, including the use of text, graphic materials, photos, applications, databases, or other content, does not imply that the User acquires any rights regarding the indicated content, and in particular does not imply the acquisition of copyright, related rights, or licenses.

 

4. The following actions are prohibited without the explicit consent of the Service Provider:

a. copying, modifying, and electronically transmitting or otherwise distributing the Portal or its parts, as well as individual content provided through it,

b. distributing in any way the content published on the Portal,

c. downloading database content and its secondary use in whole or in part.

 

 

XI. FINAL PROVISIONS

 

1. The Service Provider reserves the right to change these Regulations. The Service Provider will notify of changes to the Regulations on the Portal's website at least 14 calendar days before the changes come into effect. Changes to the provisions of the Regulations do not apply to Users who have placed an order for a paid Service during the validity of the previous version of the Regulations. Changes to the Regulations during the duration of a continuous contractual relationship bind the other party if the requirements specified in Article 384 have been met and the party has not terminated the contract within a notice period of 14 calendar days.

 

2. The Service Provider reserves the right to temporarily disable access to the Portal or selected functionalities of the Portal if necessary for the development or maintenance of the technical or teleinformatics resources of the Service Provider related to the operation of the Portal.

 

3. In other matters not regulated by the provisions of these Regulations, the relevant provisions of Polish law shall apply.

 

4. Disputes arising from the provision of services based on these Regulations will be submitted to the common court according to the seat of the Service Provider, unless the relevant provisions state otherwise.

 

5. A consumer user has the right to utilize out-of-court methods for dispute resolution and to seek claims through mediation or arbitration. Regardless, the consumer may also seek assistance from the municipal (county) consumer ombudsman. All necessary information can be obtained on the website of the Office of Competition and Consumer Protection atwww.uokik.gov.pl.Additionally, a consumer user may take advantage of the electronic method for resolving disputes with the Service Provider through the ODR platform available athttp://ec.europa.eu/consumers/odr.

 

6. The regulations come into effect on March 19, 2026.
